RESOLUTION NO. 24, Series of 2011

A RESOLUTION ADOPTING THE REVISED UNIFORM REPORTORIAL REQUIREMENT (URR) BY ALL DISTRIBUTION UTILITIES

WHEREAS, on July 13, 2009, the Commission issued Resolution No. 17, series of 2009, requiring the distribution utilities (DUs) to implement and comply with the Uniform Reportorial Requirement (URR) starting January 2010 by submitting one (1) electronic copy and two (2) hard copies of the accomplished URR model together with supporting documents, on or before the 30th day of the following month;

WHEREAS, on December 16, 2009, the Commission issued Resolution No. 24, series of 2010, suspending the submission of the URR due to the on-going review of the Implementing Rules and Regulations (IRR) of Republic Act No. 7832, otherwise known as the "Anti-Pilferage of Electricity and Theft of Electricity Transmission Lines/Materials Act of 1994" and to the filing of the on-grid Electric Cooperatives (ECs) pursuant to the "Rules for Setting the Electric Cooperatives' Wheeling Rates" (RSEC-WR);

WHEREAS, on June 18, 2010, the Department of Social Welfare and Development (DSWD) promulgated the "Implementing Rules and Regulations of Republic Act No. 9994", otherwise known as the "Expanded Senior Citizens Act of 2010", where the Commission was tasked to formulate supplemental guidelines for the electric industry;
WHEREAS, on October 18, 2010, the Commission issued Resolution No. 21, series of 2010, amending the System Loss Rate Over/Under Recovery formula in Section 4, Article 4 of the "Rules Governing the Automatic Cost Adjustment and True-Up Mechanisms and Corresponding Confirmation Process for Distribution Utilities";

WHEREAS, on December 15, 2010, the Commission promulgated the "Rules Implementing Discounts to Qualified Senior Citizen End-Users and Subsidy from the Subsidizing End-Users on Electricity Consumption Under Sections 4 and 5 of Republic Act No. 9994";

WHEREAS, on March 7, 2011, the Commission issued Resolution No. 7, series of 2011, allowing the DUs to include in their monthly computations of transmission cost the three percent (3%) national franchise tax as approved in the Final Determination of the National Grid Corporation of the Philippines (NGCP) for the 2011-2015 Regulatory Period;


WHEREAS, with the new developments in the industry brought about by the promulgation of various Rules and Resolutions, the Commission deemed it proper to revise and improve the URR;

NOW THEREFORE, the Commission hereby RESOLVES, as it is hereby RESOLVED:
  1. To approve and adopt the revised URR excel model with its output data which shall serve as the monthly reportorial submission of the DUs in lieu of ERC DU-M01, ERC DU-M02 and other monthly calculations, to be submitted as part of the reportorial requirements, hereto attached as "Annex A" and made an integral part of this Resolution;
  2. To direct all DUs to implement and comply with the URR submission starting January 2012 by submitting one (1) electronic copy and scanned supporting documents, such as power supplier's invoice, transmission invoice, consumer bills, debitlcredit memorandum, among others and two (2) hard copies of the accomplished URR model together with supporting documents, on or before the 30t day of the following month; and
  3. To undertake information dissemination to all DUs on the use of the revised URR model to ensure common understanding in filling up the model and for their strict and timely submission.
This Resolution shall take effect beginning January 2012.

Let copies of this Resolution be published in a newspaper of general circulation in the Philippines, be posted in the Commission's website and filed with the University of the Philippines Law Center - Office of the National Administrative Register (UPLC-ONAR).
