I am interested to know whether I can apply for a visa as a permanent resident if I stay in the Philippines for more than 10 years.Jim Dear Jim,The Philippine government encourages foreigners to visit the Philippines because it will be good for its economy in terms of promoting local tourism. However, the settlement of foreigners in the Philippines is regulated by laws in order to protect Filipino citizens from undesirable aliens. Another reason for the regulation of foreign immigration in the Philippines is the reciprocity agreement of the Philippines with another country, or the lack thereof. More often than not, the Philippines grants immigrant status to a foreigner only to the same extent as that which his or her country grants to Filipinos. When it comes to permanent residence in the Philippines, there are two types of immigrant visas granted: (1) quota immigrant visa, and (2) non-quota immigrant visa. Insofar as quota immigrant visa, this is granted to nationals of certain countries who are admitted only if they do not exceed 50 of any one nationality or without nationality for any one calendar year (Section 13, Philippine Immigration Act of 1940). At present, Malaysia is not one of those countries granted this type of visa. But since this visa is granted on a calendar basis, you may, from time to time, visit the Bureau of Immigration which is located at Magallanes Drive, Intramuros, Manila and inquire as to when your country will be included for the grant of quota visa. However, you may opt to apply for non-quota immigrant visa if you fall under any of the following groups: “[a The wife or the husband or the unmarried child under 21 years of age of a Philippine citizen, if accompanying or following to join such citizen [b] A child of alien parents born during the temporary visit abroad of the mother, the mother having been previously lawfully admitted into the Philippines for permanent residence, if the child is accompanying or coming to join a parent and applies for admission within five years from the date of its birth [c] A child born subsequent to the issuance of the immigration visa of the accompanying parent, the visa not having expired [d] A woman who was a citizen of the Philippines and who lost her citizenship because of her marriage to an alien or by reason of the loss of Philippine citizenship by her husband, and her unmarried child under 21 years of age, if accompanying or following to join her [e] A person previously lawfully admitted into the Philippines for permanent residence, who is returning from a temporary visit abroad to an unrelinquished residence in the Philippines or [g] A natural-born citizen of the Philippines, who has been naturalized in a foreign country, and is returning to the Philippines for permanent residence, including his spouse and minor unmarried children, shall be considered a non-quota immigrant for purposes of entering the Philippines.” (id) Again, we would like to reiterate that reciprocity agreements must be considered even under this type of visa.Editor’s note: Dear PAO is a daily column of the Public Attorney’s Office.
