Noncompliance with PH Time by radio station
"I regularly hear the morning radio to get the latest news and events in our country. I was able to observe for the past weeks that the radio announcer usually gave a time more advanced than the Philippine Standard Time (PST). Is the radio station violating any law?Mario Dear Mario,For your information, the law that addresses your situation is Section 7 of the Philippine Standard Time Act of 2013, which states that: “Section 7. Violations. – The NTC (National Telecommunications Commission) shall have jurisdiction to enforce obedience to the provisions of this Act by writ of injunction or by other process, mandatory or otherwise, restraining further violations of this Act and enjoining obedience thereto.“Owners of private television and radio stations who shall fail to calibrate and synchronize their time devices with the PST during their broadcast shall, upon hearing and due proceedings, be penalized with a fine of not less than Thirty thousand pesos (P30,000.00) but not more than Fifty thousand pesos (P50,000.00) and in case of second offense, revocation and cancellation of their franchises to operate. “The fine to be collected as penalty for the violation of this Act shall be deposited in the general fund of the National Treasury.” (Emphasis supplied)It is clear from the provisions cited above that the owners of private television or radio station that do not announce the correct PST may be penalized by a fine or cancellation of their franchise. We hope that we were able to answer your query. Please be reminded that this advice is based solely on the facts you have narrated and our appreciation of the same. Our opinion may vary when other facts are changed or elaborated.Editor’s note: Dear PAO is a daily column of the Public Attorney’s Office.
